GENERAL TERMS & CONDITIONS


1. Scope


All services are provided by Veronika Puchkova (“the Photographer”) based on the following Terms & Conditions. By booking a session, the client agrees to these terms unless otherwise agreed in writing.


2. Copyright & Usage Rights


All images remain the intellectual property of the Photographer. The client receives a non-exclusive, non-transferable license for private use only, unless otherwise agreed in writing.


Private use includes:

  • personal social media
  • printing for personal purposes
  • sharing with friends and family


Any commercial use — including but not limited to business websites, advertising, branding, resale, or third-party use — requires a separate written agreement and may be subject to additional licensing fees.


Images may not be altered, edited, or filtered without prior permission.


When sharing images online, crediting the Photographer (e.g. @viennaportrait) is highly appreciated.


3. Booking & Fees


All fees are based on the Photographer’s price list or agreed upon individually. No VAT is charged in accordance with the Austrian small business regulation (§6(1)27 UStG). Additional costs (studio, models, travel over 40 km from Vienna, props, etc.) are charged separately.


For bookings longer than 2 hours, a deposit of 50% is required to secure the session. Shorter sessions do not require a deposit unless agreed otherwise. The remaining balance is due within 14 days after invoicing. Payment can be made via bank transfer or in cash. Payments are considered completed once the amount has been received by the Photographer.


4. Services & Artistic Approach


The Photographer provides services with professional care and artistic discretion. The client acknowledges that the Photographer’s style is subjective and accepts the creative direction, editing, and final image selection.


5. Delivery


Final edited images are delivered digitally within an agreed timeframe. The Photographer is not obliged to provide RAW or unedited files.


6. Photographer’s Portfolio Use


The Photographer may use images for portfolio, website, social media, and self-promotion.

If the client prefers not to have their images published, they must inform the Photographer in writing before the shoot.


7. Cancellation & Rescheduling


If the client cancels the booking in less than 2 days before the photoshoot, the deposit is non-refundable.

Rescheduling is possible depending on availability. Short-notice cancellations or repeated rescheduling may incur additional fees.


8. Force Majeure & Unforeseen Events


In case of circumstances beyond the Photographer’s control (e.g. severe weather, illness, travel disruptions, government restrictions), the Photographer reserves the right to reschedule the session or offer other locations (e.g. indoor).


If rescheduling is not possible, the session may be cancelled. In this case, any payments made will be refunded.


9. Liability


The Photographer is only liable for damages caused by intent or gross negligence.

No liability is assumed for:

weather conditions

delays outside the Photographer’s control

loss of opportunity or indirect damages

In any case, liability is limited to the amount paid by the client.


10. Client Responsibility


The client is responsible for ensuring that all participants of the session agree to be photographed.


For private locations or special venues (e.g. indoor spaces, hotels, or restricted areas), the client is responsible for obtaining any necessary permissions if required.


11. Data Protection


Personal data is processed solely for the purpose of fulfilling the contract and communication. The client has the right to request access, correction, or deletion of their data at any time.


12. Final Provisions


Austrian law applies. The place of jurisdiction is Vienna, Austria.

If any provision of these Terms is invalid, the remaining provisions remain unaffected.
